This essay is for a business law analyzing the present and future impacts of a court case as well as evaluating relating legal concepts. For this essay I have chosen to analyze the supreme court case NATIONAL COLLEGIATE ATHLETIC ASSOCIATION V. ALSTON. Essay should include a well-stated thesis, analysis of topic, and a strong conclusion. For instance, the writer can suggest that this case has paved the way for universities and colleges to directly pay their players. Writer must use Chicago style footnotes, include an ending bibliography, use at least 9 sources, and include analysis of legal principles!
Please make sure to focus some on the state of affairs currently, and, if at all possible, offer your opinion. Don’t just make the paper read like a long magazine article or general description, because 40 points of the paper come from analysis. Analysis of legal concepts, in some capacity, is a must.
Rubric:
1. A well-stated thesis – understandable? What is the author (the student) trying to do?- 5 pts.
2. Analysis of Topic – 40 pts.
3. Clarity of Paper – 10 pts.
4. Strong Conclusion? (Has the author attempted to prove anything? IF so, given the brevity of the
paper, has he/she been successful) – 10 pts.
5. Writing, Spelling, Punctuation – 20 pts. You will receive fewer points on your paper for grammatical
mistakes, especially ones that I specifically advise against.
6. Sources – Quality and Number (the author should cite at least nine different sources, unless there is an
understandable reason; the sources should be of different types, and most should be recent in origin
whenever practical and appropriate for the paper) – 15 pts.
Instructions from the professor:
The completed paper should be from 2,200 to 2,800 words, with that total not counting the citations, the footnoted materials, or any bibliography or title page. While writing more than 2,800 words will NOT lead to a penalty (you won’t be rewarded either!), writing less than 2,200 words likely will be penalized. Please submit it in Microsoft Word.
In the papers themselves, a common failing, among other things, is the absence of sources for various statements which are not yours (that you got from somewhere but have not cited). Put in footnotes one or more sources for every statement that you make which should require documentation (that is not simply your own thought).
Law sources for your paper can be found from many avenues – Findlaw, Justia, Cornell Law School digital library, Lexis-Nexis (this one is available in the digital databases for the UF Libraries) and many others.
The completed paper should be from 2,200 to 2,800 words, not counting the citations.

Here is the question:
“The “supremacy [of European Union (EU) Law] principle” is alien to the UK constitutional system: not only did it originate outside that system, it also sits uncomfortably with established constitutional principles, most notably the doctrine of parliamentary sovereignty… The “supremacy” of EU law had ceased to apply when the UK had left the EU and the Parliament had repealed the European Communities Act 1972.”
Select Committee on the Constitution European Union (Withdrawal) Bill, 9th Report of Session 2017-19 – published 29 January 2018 – HL Paper 69, Chapter 5
In light of this statement, explain and critically discuss the creation, operation and limits of the supremacy of EU Law principle, supporting your answer with relevant Court of Justice of the European Union (CJEU) cases and academic commentary. You can briefly refer to, but do not discuss in detail the Brexit process in your answer.

For this assignment, you will be reviewing a sample contract and identifying key

For this assignment, you will be reviewing a sample contract and identifying key terms that affect areas of risk then proposing ways to mitigate those risks. That is an important skill for contract negotiations and risk management. We understand this will be new to many of you. The goal of this assignment is to help you practice reviewing a contract and applying the skills we have covered in the class so far. There is no one “correct” answer. We expect the responses and your comments will vary based on your experiences and perspective on the contract terms. This Assignment is worth a total of 100 points.
Facts: You work for a company called National Restaurant Chain (the “Buyer”). You are negotiating a contract to purchase uniforms from ABC Uniform Company (the “Seller”). The companies have already engaged in initial discussions and entered into a Letter of Intent that outlines the basic terms of the contract. Please read the Letter of Intent
to get an understanding of the basic terms the parties have agreed to.
Assignment: Review the draft Sale of Goods Agreement
that is included with the materials. It is your job to review the Sale of Goods Agreement to: 1) make sure that it contains the same terms as the Letter of Intent; 2) identify any areas of risk that may need further negotiations before the parties sign; and 3) identify any important contract terms that may be missing.
Step 1: Complete the Contract Profile Form
with the terms from the Sale of Goods Agreement. This will help you to identify the key terms and any terms that may be missing. On the Contract Profile Form, there are different columns where you can type in information from the contract. This Form is designed to be a summary of the important terms. You do not need to copy/paste the complete provision from the Agreement. Instead, put in a short description of the term. If there is a term that is missing, leave it blank. This is a tool to help you identify and summarize terms from the Agreement. You may want to refer to the Contract Review Checklist
included in your readings. Your grade will be based on whether you identify the terms from the Agreement, not on how you describe them. This portion of the Assignment is worth 50 points.
Step 2: In a separate document, put together a Memo with responses to the questions below. These can be short responses with bullet points and explanations. Each question is worth 10 points.

1) Are there any terms in the Agreement that are different than what is in the Letter of Intent? If there are, identify the differences so they can be corrected in the Agreement.

2) As the Buyer, identify 3 areas of risk that your company has in the Agreement and suggest ways to mitigate those risks. That could be financial risk, operational risk, risk from external factors or potential areas of liability. For each area of risk, identify the section of
the Agreement that is relevant and things your company should consider to help mitigate the risk.

3) Section 17.06 of the Agreement titled “Dispute Resolution” is incomplete. Make a suggestion for what to propose in this Section.

4) Are there any terms that are missing that you think should be added to the Agreement?

5) If you wanted to add a Service Level Agreement or Key Performance Indicators to this Agreement, what are you some things you would consider?

6) Bonus Question for Extra Credit of 10 points (Completely Optional): Now, switch sides and look at the Agreement from the perspective of the Seller. What is a key area of risk for the Seller? Identify 2 provisions in the Agreement that present risk to the Seller and suggest ways for the Seller to mitigate those risks.

Final Product: Memorandum with Completed Contract Profile Form Attached

This means that you can pick a current event related solely to an administrative

This means that you can pick a current event related solely to an administrative law issue and/or attend/review an administrative law-related hearing, process or event in-person or virtually. If you choose to attend an event, it should discuss a purely administrative law issue and process. You would then listen in or review the current event and write about the issue at hand; the administrative process that was utilized; and your feedback/opinion about the matter heard or current event. You should be able to incorporate some of the issues discussed during the class lectures and/or readings. We provide three opportunities to submit your two required feedback papers. A rubric of the feedback paper and requirements will be available on Canvas in the next few days. In the meantime, I wanted to start this thread to begin assisting you with thinking of ideas on what you would like to write about considering the first paper is due in a few weeks. Some beneficial pointers:
Paper should be no longer than 3 pages.
It should incorporate topics discussed in class.
Please take the time to write these papers. They should be of good writing quality and please properly cite sources when needed.
The majority of your paper should discuss your analysis and conclusions about the issue discussed or if it is a hearing, the process taken and how you would have decided. Please do not just summarize the issue or hearing.
